1. Agreement to Terms

These Terms and Conditions (“Terms”) govern access to and use of www.ShindigTime.com (the “Website”), operated by ShindigTime LLC (“ShindigTime,” “we,” “our,” or “us”).

By creating an account, accessing, or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website.

You must be at least eighteen (18) years of age to create an account or host an event using the Website.

2. Description of Services

ShindigTime provides an online platform that allows users to organize and communicate details related to personal or social events.
The Website allows users to:

• • Provide event name, location, date, and description
• • Manage RSVP tracking
• • Send invitations via email
• • Create gift registries
• • Create gift exchange lists
• • Create food registry or potluck sign-ups
• • Communicate with event participants
• • Upload photos and event-related images
• • Display approved affiliate or partner banners associated with managed events

ShindigTime provides planning and communication tools only. ShindigTime does not plan, organize, host, supervise, or manage events.

3. Account Registration

To use the Website, users must register by providing:

• • A display name

Users agree to:

• • Provide accurate and current information
• • Maintain the confidentiality of login credentials
• • Accept responsibility for all activity occurring under their account

Display names must not:

• • Impersonate another person or entity
• • Contain offensive, threatening, or discriminatory language

4. User Content and Event Information

Users may submit and upload content including:

• • Messages and communications
• • Gift registry items
• • Potluck or food sign-up information
• • Photos or images
• • Affiliate or promotional banner placements where applicable

Content Ownership
Users retain ownership of content they submit.

License to ShindigTime
By submitting content, users grant ShindigTime a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and distribute such content solely for operating and improving the Website.

5. Data Retention Policy

Account Data
User display names and email addresses will be retained until a user specifically requests deletion of their account and associated personal data.

Event Data
Event-related data may be retained for internal record keeping, service improvement, security monitoring, and operational purposes for a period of up to three (3) years following the event date. ShindigTime does not sell or share user account data or event data with third-party marketing vendors.

6. Photo Uploads and Affiliate Content

Users may upload photos or images related to events. Users represent that they have all necessary rights and permissions to upload such content.

ShindigTime may allow approved event planning organizations or affiliates to display banner or promotional material on events they manage. Users agree that:

• • Affiliate banners are informational and promotional only
• • ShindigTime is not responsible for affiliate services, offers, or conduct

ShindigTime reserves the right to remove any uploaded content at its sole discretion.

7. Gift Registries, Exchanges, and Potluck Listings

ShindigTime is not responsible for:

• • Accuracy of listed items
• • Quality, safety, legality, or suitability of gift or food items
• • Transactions between participants
• • Delivery or receipt of gifts or food contributions
• • Disputes among users regarding exchanges or contributions

All arrangements remain solely between users.

8. Payments and Billing

Payments are processed exclusively through Stripe.

ShindigTime:

• • Does not store credit card or banking information
• • May store transaction status and confirmation codes
• • Is not responsible for Stripe system errors or interruptions

By making payments, users agree to Stripe’s Terms of Service and Privacy Policy.

9. Refund Policy

All payments made to ShindigTime are non-refundable, including but not limited to:

• • Early termination of services
• • Account suspension or termination
• • Event cancellation
• • Removal of content or events due to Terms violations

10. Acceptable Use Policy

Users agree not to:

• • Post hate speech, threatening, or abusive content
• • Harass or intimidate other users
• • Post illegal, fraudulent, or deceptive material
• • Upload copyrighted material without authorization
• • Attempt to hack, disrupt, or misuse the Website
• • Send spam or unsolicited mass invitations

11. Moderation and Enforcement

ShindigTime reserves the right, at its sole discretion, to:

• • Remove content
• • Cancel events
• • Suspend or terminate accounts
• • Restrict access to Website services

No refunds will be provided for enforcement actions taken under these Terms.

12. Event Responsibility Disclaimer

ShindigTime is not responsible for:

• • Activities occurring at events
• • Personal injury or property damage
• • Alcohol or substance use
• • Safety, supervision, or security of events
• • Compliance with local laws, permits, or venue requirements
• • Behavior of event hosts or attendees

Event hosts assume full responsibility for event planning and execution.

13. Events Involving Minors

Event hosts are solely responsible for:

• • Supervision and safety of minors attending events
• • Obtaining parental or guardian consent when necessary
• • Compliance with all laws regarding minors

ShindigTime does not monitor or verify age of event attendees and assumes no responsibility for minor participation in events.

14. Third-Party Links and Services

The Website may contain links to third-party services, including Stripe and affiliate partners.
ShindigTime does not control and is not responsible for third-party services or content.

15. Intellectual Property

All Website design, software, branding, and content are owned by ShindigTime LLC and protected by intellectual property laws.

Users may not copy, distribute, or reproduce Website materials without written permission.

16. Service Availability

Services are provided on an “as-is” and “as-available” basis.

ShindigTime does not guarantee uninterrupted or error-free operation.

17. Limitation of Liability

To the fullest extent permitted by law, ShindigTime LLC shall not be liable for:

• • Gift or registry disputes
• • Property loss or damage
• • Financial losses
• • Data loss
• • Personal injury
• • Third-party service failures

ShindigTime’s total liability shall not exceed the total fees paid by the user within the previous twelve (12) months.

18. Indemnification

Users agree to defend, indemnify, and hold harmless ShindigTime LLC from any claims, damages, or liabilities arising from:

• • Violations of these Terms
• • Disputes between users

19. Termination

Users may terminate accounts at any time by contacting support.
ShindigTime may suspend or terminate accounts without notice for violations of these Terms.

20. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising from use of the Website or these Terms shall be resolved through binding arbitration, rather than court litigation, except where prohibited by law.

Arbitration shall:

• • Be conducted in the state where ShindigTime LLC is registered
• • Be administered by a recognized arbitration organization
• • Be conducted on an individual basis only
• • Prohibit class-action claims

Users waive the right to participate in class action lawsuits against ShindigTime.
Either party may seek relief in small claims court where eligible.

21. Changes to Terms

ShindigTime may update these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.

22. Governing Law

These Terms shall be governed by the laws of the state in which ShindigTime LLC is registered.
